About EquiMaps

EquiMaps is a mobile application for horse riders for planning, navigating and recording rides. The app is provided by MichaelTan eenmanszaak (Michael Tan, Chamber of Commerce (KvK) number: 85226467, registered address: Hoogstraat 54, Tegelen, mjw-tan@outlook.com).

Minimum age

You must be at least 16 years old to create an account and use EquiMaps. If you are under 16, you may only use the app with the permission of your parent or guardian, who thereby also agrees to these terms and the privacy policy. We use 16 because that is the age in the Netherlands at which you may give consent yourself under the GDPR for the processing of your personal data; that threshold applies to all users, including outside the Netherlands. If it turns out that someone under 16 has an account without that permission, we may delete the account.

Account

You are responsible for keeping your login details confidential and for all activity that takes place under your account.

Use

The app is intended solely for lawful and personal use. Not permitted:

Premium subscription

Premium is available as a monthly or annual subscription. You see the current prices and terms in the app and in the App Store or Google Play before you take out a subscription; those prices apply.

The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. If you subscribe via the App Store, you manage and cancel it in your Apple account settings; via Google Play you do so in your Google Play settings. Deleting your account does not cancel a subscription. No refunds are given for current subscription periods, except where applicable law or the policies of Apple or Google require it.

User content

User content is everything you post in the app yourself: routes and route names, photos (of routes, horses, your profile and scare alerts), reviews, scare alerts with their description, your profile details and ride data you share. You remain the owner of your content.

You grant EquiMaps a non-exclusive, royalty-free licence to store and process your content and to show it to other users within the app, insofar as necessary for the service: for example public routes and reviews in the route list and scare alerts on the map. The licence ends as soon as you delete the content or your account, with the exception of copies in backups, which disappear within the retention period set out in the privacy policy.

Not permitted is content that:

You warrant that your content complies with these rules and that you have the consent of people who are identifiable in your photos.

Reporting, removal and blocking

Do you see content or behaviour that is unacceptable? Report it via the report function on the route, review, scare alert or rider profile in question, or email mjw-tan@outlook.com with a link or description. We review reports within 24 hours and remove content that violates these terms or the law.

In the event of a breach of these terms, abuse of the report or review function, or behaviour that harms the safety or use of the app by others, we may remove content and restrict, block or delete accounts.

You can also block other riders yourself via their profile or from a report. You will then no longer see their routes, reviews and scare alerts. You can unblock via Profile → Blocked users (Profiel → Geblokkeerde gebruikers).

Safety

EquiMaps is not an emergency service and does not replace an emergency number. In an emergency, always call 112.

The safety alert is an inactivity detection, not a fall detection. If your phone does not move for several minutes during a ride you are recording or navigating and you do not respond to the check-in prompt, the app gets a message with your last known location for your emergency contact ready in WhatsApp; WhatsApp does not send it by itself, someone has to tap send there. A fall or accident is not recognised as such, and the alert does not work without an emergency contact set, without an active ride, without location access, with a flat or switched-off phone or without network coverage. There is no guarantee that the message arrives or that help arrives in time.

Scare alerts are reports from other riders. We do not check them in advance and do not guarantee that they are accurate, complete or up to date; a hazard without a scare alert may also exist. The same applies to the warning while riding and the push notification for a new scare alert nearby, which depend on GPS accuracy, network coverage and your settings. Reviews and route data also come from users and may be incorrect or outdated. A route in the app does not mean you are allowed to ride there or can do so safely: watch for signage, traffic, terrain and the condition of your horse yourself.

Liability

To the extent permitted by law, EquiMaps is not liable for damage arising from use of the app while horse riding. This exclusion does not apply to damage caused by intent or gross negligence on the part of EquiMaps, and does not affect the rights you are entitled to as a consumer under mandatory law. Use is at your own risk. The app is not a substitute for professional advice on safety or routes.

We do not guarantee uninterrupted availability of the service.

Changes to these terms

We will notify you via the app of important changes to these terms. If you use the app after a change, the new terms apply.

Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands. As a consumer, you may also bring a dispute before the court of your own place of residence.
